Terms and Conditions
The terms that govern your use of this website and our dispatch services.

1. Who We Are
MMS Traders is a truck dispatch company based in Houston, Texas. We act as an authorized agent of motor carriers to locate freight, negotiate rates, and coordinate load-related administration. MMS Traders is not a motor carrier, freight broker, or freight forwarder, and does not take possession of or assume liability for freight.
2. Our Services
Subject to a separate dispatch agreement, our services may include:
- Sourcing and booking loads that match your equipment, lanes, and schedule
- Negotiating rates with brokers and shippers on your behalf
- Route and back-haul planning to reduce deadhead miles
- Preparing and processing rate confirmations, BOL coordination, and check calls
- Completing carrier packets and broker or shipper setups in your name
No load is booked without your approval. We present the load and the rate; the decision to accept or decline is always yours.
3. Carrier Eligibility and Responsibilities
To use our dispatch services, you represent and warrant that you:
- Hold active operating authority and a valid MC and DOT number
- Maintain the insurance coverage required by law and by the brokers and shippers you haul for
- Comply with all applicable FMCSA regulations, including hours-of-service and drug and alcohol testing requirements
- Operate safe, properly maintained, and legally registered equipment
- Provide accurate and current information to us at all times
You remain solely responsible for the safe and lawful operation of your equipment, for the performance of every load you accept, and for the condition of the freight you haul.
4. Authorization to Act
By engaging our services, you authorize MMS Traders to communicate with brokers, shippers, and receivers on your behalf, to complete carrier setup packets in your name, and to negotiate and accept load terms that you have approved. This authorization may be revoked in writing at any time.
5. Fees and Payment
Our fee is a percentage of the gross line-haul rate on loads we book for you, as set out in your dispatch agreement. There are no monthly minimums and no fee on weeks in which no load is booked. Invoices not paid by the agreed due date may result in a suspension of dispatch services.
6. No Long-Term Contract
There is no long-term commitment. Either party may end the dispatch relationship with written notice as specified in your dispatch agreement. You remain responsible for fees on loads already booked and delivered prior to termination.
7. No Guarantee of Freight or Rates
Freight availability and rates are set by market conditions we do not control. While we work to secure the best available rates for your lanes and equipment, MMS Traders does not guarantee any particular volume of loads, revenue level, or rate per mile.
8. Payment for Loads
Payment for freight is made by the broker or shipper directly to you, or to your factoring company, under the terms of the rate confirmation. MMS Traders does not collect, hold, or disburse freight payments and is not responsible for a broker’s or shipper’s failure to pay.
9. Limitation of Liability
To the fullest extent permitted by law, MMS Traders is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, detention, layover, or downtime. Our total liability arising out of or relating to our services will not exceed the total fees you paid to MMS Traders in the three months preceding the event giving rise to the claim.
10. Cargo Claims and Disputes
Cargo loss and damage claims, and disputes over freight charges, are between you and the broker or shipper. We will assist with reasonable documentation and communication, but MMS Traders is not a party to those claims and assumes no liability for them.
11. Website Use
The content on this website is provided for general information only and does not constitute legal, financial, or regulatory advice. You agree not to use the site unlawfully, to attempt to gain unauthorized access to it, or to interfere with its operation. All site content, branding, and design are the property of MMS Traders and may not be reproduced without written permission.
12. Privacy
Your use of our website and services is also governed by our Privacy Policy and, where you have opted in to text messaging, our SMS Terms of Service.
13. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising under these Terms will be brought in the state or federal courts located in Harris County, Texas.
